Weights & Biases New Master Service Agreement Questions [D]
W&B can now use your ML models to train AI without opt-out.
Weights & Biases, the popular MLOps platform, sent users a new Master Service Agreement effective May 11. The Reddit community flagged significant changes that threaten intellectual property rights. Previously, Section 8(b) explicitly stated customers own and retain all rights to their Customer Data, which includes machine learning models, deep learning research, visualizations, and analyses. That clause has been entirely removed.
The new agreement grants W&B the right to use Customer Data to (i) provide and improve the W&B Assets, (ii) develop new product offerings, and (iii) provide and improve AI Features—meaning your models and logs can be used to train W&B's own AI. The earlier agreement only allowed use to “provide the Software and Service.” Additionally, Customer Data now survives termination under Section 6(e). While the agreement notes that free and academic customer data may be used for testing and development, it fails to differentiate treatment for Pro and Enterprise customers, and no opt-out mechanism is offered. The community is concerned that enterprises may need a separate contract to protect their data.
